Movie bosses claim Paz de la Huerta has no right to sue them over an onset accident because she already accepted a compensation payment over injuries she sustained while filming Nurse 3D.
De la Huerta has filed a lawsuit against Lionsgate Films over allegations she suffered near-fatal injuries when she was hit by an ambulance while filming the horror movie in Ontario, Canada in October, 2011.
The 30 year old clams she suffered serious injuries and needed 20 surgeries, and she is seeking unspecified damages for negligence.
However, Lionsgate bosses have now filed court papers asking for her lawsuit to be dismissed, claiming she had given up her right to damages by accepting a previous compensation payment of $73,000 (£45,625).
The motion was filed at the Supreme Court of the State of New York earlier this month (Dec14).
